Process Flow

Flowchart for Legislative Proposal

How a provincial ordinance or resolution is passed under the Local Government Code. Details follow the Sanggunian's internal rules.

01

File Proposed Ordinance

A board member files the proposed ordinance with the Secretary to the Sangguniang Panlalawigan. The Governor may also propose measures.

02

First Reading / Referral to Committee

The title is read in session and the measure is referred to the committee concerned.

03

Public Hearing / Committee Action

The committee studies the measure and may hold public hearings. A public hearing is required before a tax ordinance is enacted (LGC Sec. 187).

04

Committee Report

The committee reports its findings and recommendation to the full Sangguniang Panlalawigan.

05

Second Reading

Members debate the proposed ordinance and propose amendments.

06

Third and Final Reading

The Sanggunian votes on the final text. A quorum (a majority of all members) must be present.

07

Presented to the Governor

The enacted ordinance goes to the Governor, who signs each page to approve it (LGC Sec. 54).

08

Approval or Veto (15 Days)

The Governor may veto it in writing within 15 days if it is beyond the Province's powers or harmful to public welfare. Items of an appropriation ordinance can be vetoed separately. With no action in 15 days, it is deemed approved (LGC Secs. 54–55).

09

Veto Override

The Sanggunian can override a veto by a two-thirds vote of all its members. The Governor can veto a measure only once.

10

Posting / Publication

Within 5 days of approval, it is posted at the Provincial Capitol entrance and in at least two other conspicuous places. The gist of an ordinance with penalties is published in a newspaper of general circulation in the province.

11

Takes Effect

Unless it states otherwise, the ordinance takes effect 10 days after posting (LGC Sec. 59) and is enforced across the province.

01

File Proposed Resolution

A board member files the proposed resolution with the Secretary to the Sangguniang Panlalawigan.

02

Inclusion in Session Agenda

Resolution is scheduled for inclusion in the Sangguniang Panlalawigan session

03

Committee Meeting / Approval

The committee concerned reviews it. Some resolutions are taken up directly in session when the internal rules allow.

04

Approval in Session

Members vote on the resolution in a regular or special session.

05

Official Signing

The Secretary to the Sanggunian attests it and the Vice Governor certifies it. Resolutions adopting a development plan or public investment program are also subject to the Governor's approval.

06

Posting / Transmittal

Resolution is posted publicly and transmitted to concerned parties

Province, Cities and Municipalities

Provincial and City/Municipal Ordinances

Bukidnon has 2 component cities and 20 municipalities. Each has its own legislative council.

Who Legislates What

The Sangguniang Panlalawigan passes ordinances within the Province's powers, such as provincial taxes and fees, the provincial budget, and provincial programs and facilities. The Sangguniang Panlungsod of Malaybalay City and of Valencia City and the Sangguniang Bayan of each municipality legislate for their own city or municipality, for example on business permits, public markets and tricycle franchises.

Review by the Province (LGC Sec. 56)

Within 3 days after approval, each city and municipal sanggunian sends the Sangguniang Panlalawigan copies of its approved ordinances and of resolutions approving local development plans and public investment programs. The Sangguniang Panlalawigan reviews them within 30 days of receipt.

Result of the Review

If the Sangguniang Panlalawigan finds that an ordinance goes beyond the powers of the city or municipal sanggunian, it declares the ordinance invalid in whole or in part. If it takes no action within 30 days, the ordinance is presumed consistent with law and valid.

Barangay Ordinances

Barangay ordinances are reviewed by the city or municipal sanggunian, not by the Province (LGC Sec. 57). For a city, municipal or barangay ordinance, ask the city or municipal hall concerned.

Ordinances

Local laws of general and lasting application. Provincial ordinances apply throughout Bukidnon, within the powers the Local Government Code gives provinces.

Resolutions

Expressions of the legislative body's will or opinion on specific matters, often used for commendations, requests, or policy positions.
